No alcohol allowed for 18-year-old

Magistrate Janet Wahlquist told an 18-year-old man he should not have any alcohol in his system when driving a car before fining him $400 and disqualifying him from driving in Mudgee Local Court on September 23.

Chadd Gregory Glassey of Arcadian Road Kurrajong had pleaded guilty to a low range drink drive offence after he failed a roadside breath test in Douro Street Mudgee at 4.20am on May 22.

A later breath analysis resulted in a PCA reading of 0.070.

Ms Wahlquist said that as a P2 driver he should not have been drinking at all and should have a zero alcohol level when driving.

“If you have a need for a driver’s licence you have to value it and not drink at all before driving,” Ms Wahlquist said.

After sentencing Glassey, Ms Wahquist reminded him that he can go to gaol for driving while disqualified.

Knew he had been suspended

A driver who was stopped by police in Cox Street Mudgee at 2pm on July 25 told police he knew his licence had been suspended because of fine default.

Police had seen Christopher Smith, 28, of Cox Street Mudgee driving in Church Street and knew his licence had been suspended.

They followed his vehicle to his Cox Street address.

Police said that Smith’s licence had been suspended on July 16 for three months because of fine default.

Magistrate Janet Wahlquist considered submissions from the defendant in Mudgee Local Court on September 23 that he would have problems getting a job and taking his ill grandmother to appointments before fining him $300 plus costs and disqualifying him from driving for three months.

Suspended prison sentence

Magistrate Janet Wahlquist imposed a suspended prison sentence for a drink drive offence after a Wollar man was convicted of a high range drink drive offence in Mudgee Local Court on September 23.

Bruce Allan Aylett, 41, of Price Street had been stopped by police for a random breath test on Wollar Road Cooyal on May 22 when a passive test resulted in a positive result and a PCA reading of 0.233.

A breath analysis after his arrest resulted in a reading of 0.195.

When stopped he told police he had never held a driver’s licence.

Ms Wahlquist placed Aylett on a six-month good behaviour bond in lieu of the prison sentence and disqualified him from driving for two years.

He was also ordered to serve a 100-hour community service order on a charge of drive while disqualified and imposed a further concurrent two-year disqualification of driving licence.

Charged with driving for too long

A truck driver who did not take enough rest while driving on the Pacific Highway on January 13 and 14 was fined over two offences in Mudgee Local Court on September 23.

James Anthony Charles was represented by Mudgee solicitor Richard Flynn and the RTA by Mudgee solicitor Allan Hogan when the matter came before Magistrate Janet Wahlquist.

Charles was stopped at Wyong on January 14 and was charged with failure to have seven hours’ rest in the previous 24 hours. He had only had five and a half hours’ rest.

At 3pm on January 14 he was again stopped at Taree and was charged with working more than 12 hours in the previous 24 hours.

Mr Flynn submitted to the court that Charles, of Flett Street Taree has been driving trucks for 15 years and drives about 120,000 kilometres a year.

“My client thought that the number of hours he was allowed to drive was for a daily 24-hour period and not a continuous 24-hour period (from 10am one day to 10am the next),” Mr Flynn said.

Ms Wahlquist fined Charles $200 plus costs on each offence.

Fined over assault on woman

Magistrate Janet Wahlquist fined Robert Jon Van Putten $200 plus costs after he was convicted on a charge of assault occasioning actual bodily harm in Mudgee Local Court on September 25.

Police evidence stated that at about 3pm on April 11 Von Putten’s defacto had told him she was disgusted with him because of alcohol consumption and the accused retaliated by head butting his de facto.

Trading with no dealer’s licence

A Mudgee man was fined $5,500 plus costs in Mudgee Local Court on September 24 after he was convicted on a charge of carry on trade without dealer’s licence.

The charges were brought about by the Department of Commerce Office of Fair Trading in relation to Phillip Duncan Ferguson, 51, of Castlereagh Highway Mudgee having two vehicles carrying for sale signs at his Castlereagh Highway address.

The department submitted evidence that Ferguson had an Isuzu truck carrying a “For Sale” sign with a price of $2,500 and a tractor carrying a sign with the price $7,500 when they called at the premises on May 20 and photographed the vehicles.

Resist police and offensive language

A woman who refused to leave the vicinity of licensed premises in Mudgee was sentenced on three offences in Mudgee Local Court on September 23.

At 11.25pm on July 17 Jessica Taylor, 19, of Burrundulla Avenue Mudgee had refused to leave the vicinity of the licensed premised when asked to by security.

When police attempted to assist they warned Taylor over her language and when arrested after she refused to move on struggled with police.

Police evidence stated that Taylor had been asked to leave the vicinity because of her state of intoxication.

Magistrate Janet Wahlquist fined Taylor $200 plus costs on charges of use offensive language and excluded person remain on licensed premises and placed her on a 12-month good behaviour bond on a charge of resist police officer in the execution of duty.
