A 29-year-old man charged with threatening police while he was locked up for his level of intoxication, was given a 12 month suspended jail sentence when he appeared in Mudgee Local Court last Wednesday.

Nicholas Colin Javens of Mortimer Street, Mudgee, pleaded guilty to the charge “Intimidate police officer in execution of duty without actual bodily harm”.
At about 8pm on Thursday, December 17, 2015, Javens was detained in a holding cell at Mudgee Police Station.
While there, he continually swore at and made derogatory comments towards police, before then threatening to “smash” them when he saw them in the street.
At about 11.25pm when Javens was released he began arguing with one of the officers before saying “I will get you and your family” and raised his fist to them.
He was then taken down in a wrist lock and charged.
When reading the facts submitted to the court, Magistrate Terry Lucas questioned if there was “any use of methamphetamine”, when Javens’ legal-aid solicitor Rebecca Mitchell said no his honour replied “his behaviour certainly suggests that”.
Ms Mitchell added that her client is “very sorry, he acted stupidly”.
Magistrate Lucas went on to tell the defendant “you and alcohol are not friends” because “you go too far” and added “police have a very tough job...you may not remember it but I’m sure that the officer does”.
