James Bremer, aged 25, of Inglis Street, Mudgee, was fined $1000, placed on a 12-month good behaviour bond, and disqualified for six months which will be followed by a 24-month interlock period.

At about 7.50pm on April 25, 2017, police were called to a vehicle that had crashed into a tree in Inglis Street.

Bremer admitted to driving, two other people were in the car at the time and no one was injured.

A roadside breath test was positive and he was taken to Mudgee Police Station where a breath analysis of 0.166 was recorded.

Bremer said that he lost control of the vehicle while turning onto Inglis Street from Douro Street.

And that he’d consumed 10 schooners of beer between 2pm and 7.30pm.

Bremer’s solicitor, Tom Flynn, told the court that the vehicle belonged to a friend who was the one who insisted he drive, nonetheless “it was still his decision to drive”.

Magistrate Susan McGowan upon reading the police fact sheets said to the defendant “you were almost legless on the reading” and “overcast and raining, no wonder you slid off the road”.

“As they on television, ‘have a Plan B’ it seems you and the others had no plan at all,” she said.
