A 82-year-old man who fell asleep as police were arresting him for drink driving, was disqualified for six months and placed on a six-month good behaviour bond in Mudgee Local Court.

Cyril George Allen of Cox Street, Mudgee, pleaded guilty to the charge ‘Drive vehicle under influence of alcohol’.
At about 9.55pm on Sunday, June 11, 2017, police saw Allen’s vehicle cross onto the incorrect side of the road as he drove through the intersection of Douro and Short streets.
When officers asked if he’d had any alcohol to drink he answered “yep, too much obviously”.
The roadside breath test was positive for alcohol and as Allen was being taken to the police vehicle he fell to the ground and was unable to get up again, even with officers assisting.
He then fell asleep and began snoring loudly and couldn’t be woken.
Police took Allen to the hospital where he slept for several more hours.
His solicitor, Richard Wise, told the court that his client was going to walk home that night until he realised how cold it was.
Magistrate Terry Lucas told the defendant, “I would’ve thought someone your age would have more common sense”.
