Aaron David Jackson, aged 25, of Henry Street, Chittaway Point, was charged with two counts of ‘Stalk/intimidate intend fear physical etc harm (domestic)’.
And Drew Benjamin Jackson, aged 23, also of Henry Street, Chittaway Point, was charged with ‘Common assault’.
On Thursday, December 27, 2018, the pair drove to Mudgee to recover property from the ex-partner.
They then went to victim’s house and accosted him in the driveway.
Aaron Jackson told him to “stay away” or “I will kill you” - the latter threat he would deny making when questioned by police.
Before Drew Jackson asked him if he was listening and slapped the victim across his face.
The pair continued yelling as they returned to their vehicle and left the location only to be stopped by police close by and arrested.
The first count of intimidation that Aaron Jackson was charged with related to the previous evening when he sent a number of threatening text messages.
When the matter was brought before Magistrate David Day on Wednesday (December 23, 2019), his honour noted the timing of the incident at the outset, when he said the court was “cleaning up the mess after Christmas Dinner”.
He referred to the slap by Drew Jackson as “a classic Central Coast assault”, recalling his time on the bench in the area.
And reflected on the seriousness of the charges of intimidation against Aaron Jackson, pointing to the threat to kill involved.
When fining the defendant, Magistrate Day said, “I’m sure he’ll agree that’s better than sending him to jail”, reiterating that the former was part of his consideration.
Aaron Jackson was also placed on an Apprehended Domestic Violence Order (ADVO).
