A man who admitted to drinking 12 beers in as many hours prior to getting behind the wheel, was sentenced for mid-range drink driving when he appeared in Mudgee Local Court.

Scott Ferguson Mackay, aged 40, of Barigan Road, Barigan, was disqualified for three months, to be followed by a 12-month interlock period, and placed on a 12-month Community Corrections Order.
Police stopped Mackay at about 10.30pm on Saturday, May 18, 2019, on the Ulan Road at Budgee Budgee, for random breath testing as part of Operation Chrome. Officers noted that he smelt of alcohol and his actions were sluggish, before he returned a positive roadside test.
He was taken to Mudgee Police Station, where a breath analysis of 0.115 was recorded.
Mackay admitted to drinking 12 full-strength beers over a 12-hour period, which his solicitor Richard Wise said his client consumed at home.
Upon reading the police facts submitted to the court, Magistrate David Day told the defendant, "I note that when you were told the reading you said 'yep', I'll take that as confirmation that you knew you shouldn't have been driving".
And that, "everyone is affected over 0.1, even the hardest drinkers".
