Laine Patrick Ginns of Saleyards Lane, Gulgong, was convicted for 'Possess prohibited drug' and sentenced to a 12-month Conditional Release Order.
The 35-year-old was stopped for a random breath test in Horatio Street, Mudgee, at about 2.30pm on Monday, August 12, 2019.
As police approached his vehicle he was seen moving around and was reaching across to the passenger side.
They also noticed a strong smell of cannabis and decided to conduct a search, which turned up 9.1g of the drug concealed within the cap of a drink bottle found on the left-hand side of the vehicle. Ginns told them it was his and he intended to smoke it himself.
Magistrate David Day told the defendant that if he's waiting for the state's legislation to go the way of the ACT's personal use laws, "don't hold your breath, because I suspect you'll run out of oxygen".
