Gregory John Davis of Rouse Street, Gulgong, was stopped by police for random breath and drug testing at about 3.15pm on Thursday, September 5, 2019.
Officers noted that all four occupants of the vehicle, which they'd stopped in Gladstone Street, Mudgee, were known to police for drug use and supply.
The 59-year-old tested positive to methamphetamine and he was taken to Mudgee Police Station, where a second oral fluid sample was taken.
Davis told police that he didn't use the drug and that someone in the vehicle was using it with a pipe, because he could smell it while driving into Mudgee from Gulgong.
Laboratory analysis of the sample detected methamphetamine, cannabis and 3,4-methylenedioxymethamphetamine (MDMA).
The defendant pleaded guilty to the charge 'Drive vehicle, illicit drug present in blood etc- 2nd + off'**'', when he represented himself in court.
Where he reiterated that he was "in the car when others were smoking meth, so that's how it ended up in my system".
Upon reading the police facts submitted for sentence, Magistrate David Day said, "all of the people who were in the car are known to the court".
However, he went on to tell Davis "your record is full of drug-related matters, including supply".
"So it's not surprising that you've come back before court," he said.
** Under the Road Transport Act, if a person is convicted of an offence it is a 'second or subsequent offence (2nd + off)' if they were convicted of another offence (the previous offence) against the same provision within five years.
