A man charged with getting into a fight in the street and using offensive language in public, after being ejected from a pub, was fined $880 and sentenced to a 12-month order requiring alcohol rehabilitation.

Michael Warren Gordon of Maloney's Road, Lue, pleaded guilty to the matter in Mudgee Local Court.
Shortly before 12.30pm on Sunday, October 20, 2019, the 39-year-old got into a heated argument at the licensed premises, which came to the attention of security. The group was ejected from the venue and once outside the altercation between Gordon and one of the other men began on the footpath.
Police, who were patrolling the Mudgee CBD, came across the incident and exited their vehicle to hear the pair yelling and swearing at each other. Gordon was heard to say "I'll do it in front of the coppers".
They then grappled and fell onto the road, with Gordon on top and holding the victim by his head, neck and body. He was stopped when police deployed their capsicum-spray.
The defendant represented himself when he fronted court on Wednesday, May 6, 2020, to face charges of 'Common assault' and 'Use offensive language in/near public place/school'.
Magistrate David Day, upon reading the facts submitted, asked "why did you get into this incident?" To which Gordon answered "I was intoxicated".
His honour then said, "correct answer", and his inquiry as to whether Gordon had a "problem with alcohol" was confirmed by the defendant.
"Most people, whey they're asked to leave the pub, don't go out and get into a fight," Magistrate Day continued.
Although he did appreciate Gordon's "insight" into his alcohol use and his being "frank" with the court.
"You clearly recognise it gets you into trouble," he said.
