Conviction necessary for defendant who 'sunk the boot in'
A Queensland man charged with his part in an assault at a Mudgee pub, wasn't afforded the leniency his co-accused received, due to his prior record and because he kicked the victim while he was on the ground.
Jonathon Rowcroft of Navua Street, Strathpine, was fined $550.
At about 12.15am on Sunday, February 22, 2020, the co-accused pulled the victim off a chair, pushed him to the ground and started punching him. This was over a dispute involving a family member of the co-accused.
While the victim was down, Rowcroft kicked him twice. The incident - which was captured on the pub's CCTV - was broken up when bystanders and security intervened.
The 25-year-old submitted a written plea of guilty to the charge of assault and was sentenced in his absence.
Magistrate David Day noted that the co-accused was before him on Wednesday, May 6, 2020, but said there would be "no parity" in sentencing.
"The co-offender was dealt with without a criminal conviction because he had no prior matters - Mr Rowcroft does," he said.
And added that defendant was "the one who sunk the boot in", which he called "a cowardly act".
'You know the phrase 'alcohol-fueled violence' - that's you'
A 25-year-old woman charged with assaulting two family members and damaging one's car, was sentenced to a 15-month Community Corrections Order with a condition that she complete rehabilitation for alcohol.
Tamara Riley of Paterson Street, Mudgee, had been drinking overnight prior to 6am, Sunday, March 1, 2020, when she returned home.
After an argument she went outside and began punching the vehicle, causing several dents, and pulled off a side mirror and indicator. During the incident she also physically attacked the victims.
Magistrate David Day, upon reading the police facts submitted to the court and her criminal record, asked her, "why do you assault people?"
To which, the defendant - who represented herself - answered, "I shouldn't drink". She also claimed to have quit since the offences.
"You've got a history of assaulting people and I worry where it comes from," his honour continued.
"On the face of it, this was a very unpleasant incident. You know the phrase 'alcohol-fueled violence' - that's you."

Fines and compensation order for shoplifting, drug possession
A man charged with shoplifting - who was also in possession of cannabis when police caught up with him - was fined a total of $330 and ordered to pay compensation of $80.
Scott Michael Martin of Denison Street, Mudgee, was seen enter Big W at about 4.10pm on Tuesday, February 18, 2020.
He took a backpack and placed a pair of thongs inside, put on a cap, and about 10 minutes later he left the store through a fire-exit door.
Staff believed that he'd taken more items, because the backpack appeared to be fuller on the CCTV footage, but not enough detail was captured. Total value of the backpack, cap and thongs, was $80.
At about 10.45am the next day, police caught up with the 45-year-old in the Mudgee CBD, wearing the stolen cap. A search revealed that he was in possession of 1.2g of cannabis.
