Anthony Kilby, 52, of Kenna Street, was representing himself when he was sentenced to the maximum jail term of seven months after firing his legal representation.

Prior to magistrate David Day's sentencing in Orange Local Court, Kilby had launched into an animated spiel, telling the court: "I don't care what you do because I've had enough".

He continued in a similar vein, taking particular umbrage with the police prosecution.

"[I] spit in your f---ing face... Whatever happens today I don't give a s--t," Kilby told the court via audio visual link from Bathurst jail.

"Stick it up your arse prosecution. I had fun anyway."

According to police, Kilby had been arrested on February 23, 2021, when he was seen driving on Sampson Street at around 1.30pm. When he was stopped by officers, Kilby "immediately pulled over, got out of the vehicle and handed police the car key".

After being refused bail in an earlier hearing of his case, Kilby had refused to take calls from his legal representation.

As the court awaited for the accused to appear via video, Mr Day wondered out loud: "I ask myself what possessed me to put him on an ICO [Intensive Corrections Order]. Perhaps I felt sorry for him."

During his outburst at the court Kilby also told Mr Day, "I'm sick and tired of you too," before concluding with: "I'm too old for this" - whereupon his sound was muted and he turned his back on the court.

"Why Mr Kilby drove a car, it remains a mystery to me," Mr Day said prior to sentencing. "My consideration now is to protect the community from Mr Kilby."

The magistrate added that there was "no indication that he has ever held a licence", nor that he understood road rules. When Kilby appeared in court he was already subject to a 70-year disqualification. Mr Day added an additional 12-month driving ban with his conviction.
