A 32-year-old man has been sentenced for mid-range drink driving, after he was stopped by police in the evening and tested positive for alcohol he’d been drinking around lunchtime.

Jared Stephen Jones of Macquarie Drive, Mudgee, was fined $880, disqualified for five months and placed on a 12-month good behaviour bond in Mudgee Local Court.
At about 8.29pm on Friday, February 16, 2018 was stopped for random breath testing in Church Street.
He admitted to drinking alcohol at about lunchtime and subsequently tested positive, he then taken to Mudgee Police Station where a breath analysis of 0.086 was recorded.
Jones told police he had about 10 beers between 11am and 3pm that day.
Magistrate David Day noted that the defendant had prior low and high range charges on his record, saying, “he has a problem with having a drink and driving”.
Although given he claimed his last drink was five and a half hours before he was stopped, “I accept that this was a simple misjudgment”.
When disqualifying Jones, Magistrate Day warned him against getting behind the wheel again.
“The penalties for driving while disqualified are more severe than what I just dished out,” he said.
