Luke Jarrod Fisher of Winchester Crescent, Cooks Gap, was sentenced to 12 months imprisonment with a non-parole period, in Mudgee Local Court.
At about 8.30am on October 27, 2017, Fisher was driving along the Ulan Road towards Mudgee when he entered the road works site north east of Hadabob Road.
The area was sign-posted reducing the speed limit from 100km/h, down to 80, 60 then 40.
The victim had a witness’s vehicle stopped ahead and was standing to their front passenger side.
They both saw Fisher approaching and didn’t appear to be slowing down.
The victim moved further off the road and the witness moved her vehicle further forward.
As Fisher got closer he noticed that the witness was stopped, he braked harshly and swerved to the left of her vehicle.
He went onto the gravel shoulder and his bullbar struck the victim, before coming to rest in a dirt table drain.
The victim was taken to Orange Health Service and treated for a serious leg injury that required surgery to correct.
Due to the seriousness of the accident the Central West Crash Investigation Unit was called and they concluded that all speed reduction signs were visible on approach.
When Fisher was questioned he said that he went down to 80km/h but not 60 or 40 because he thought they were turned away indicating they weren’t in use.
Also that he didn’t see the victim until he left the road.
Fisher was charged with ‘Dangerous driving occasioning grievous bodily harm’.
The sentence severity appeal will be heard in Dubbo District Court on July 18, 2018, and he was granted bail in the interim.
