A driver who found out his South Australian licence was invalid because a NSW disqualification period commenced shortly after he obtained it, was sentenced in Mudgee Local Court.

Daniel McMurtrie, aged 41, of Mortimer Street, Mudgee, was disqualified for a further six months and placed on a 12-month good behaviour bond for two counts of driving while disqualified.
Police stopped McMurtrie for a random breath test on Tallawang Road, Gulgong, on March 31. He handed over the SA licence, which was seen to be valid and the breath test was negative for alcohol.
However, further checks revealed that he was disqualified in NSW from October 2017 until 2033. And when he was stopped for another RBT on the Ulan Road, Mudgee, on April 11 and he was charged.
McMurtrie’s solicitor, Allan Hogan, told the court that his client wasn’t disqualified when he was issued the SA licence. Magistrate David Day pointed out once you’re disqualified in one state it applies “throughout the Commonwealth”.
