Magistrate David Day opted to fine a defendant who failed to appear in Mudgee Local Court on Wednesday, rather than issue a warrant for his arrest given his previous record of confrontations with police officers.

Jamie William Power, aged 45, of Cliftlands Road, Scone, was fined a total of $3300 for two counts of ‘Stalk/intimidate intend fear physical etc harm (personal)’.
Power had worked as a farmhand and handyman by the two victims and resided at their respective properties during his employment with each.
During the second stint of employment in October, Power had a number of heated arguments with one of the victims culminating when he was told to move out on November 19.
Two days later, he followed the other victim into a Mudgee bank and made threats to “smash” and “bury” them and said “you’re dead”, all in front of one of the tellers. The verbal abuse continued in the street until the victim rode away.
When Power failed to appear in court Magistrate Day noted that he had prior assault and resist police on his record.
“I’m inclined to fine him rather than risk the wellbeing of officers by issuing a warrant, because he’s got form in that area,” he said.
