James Spice of Lawson Street, Mudgee, pleaded guilty to 'Stalk/intimidate intend physical etc harm (domestic)' and two counts of 'Destroy or damage property (domestic)'.
At about 11.45pm on Thursday, June 6, 2019, Spice had given the victim a lift home and after entering the house they began arguing.
The victim attempted to calm him down and he got in her face, raised a fist, before punching a stereo speaker which knocked over and damaged a lamp. Feeling intimidated by his behaviour, she called the police.
Spice, who represented himself in court, submitted a letter from the victim. And while Police prosecutor Kris O'Brien didn't object to it being tendered, he did advise that "little weight" should be added to her suggestion that her level of intoxication was provocation.
To which Magistrate David Day, in a sarcastic tone, replied, "don't you know it's always the victim's fault?"
