A 23-year-old man whose only prior traffic infringement was a ticket, has been sentenced for a mid-range drink driving charge that the Magistrate called an "act of foolishness".

Brennan Thompson of Redbank Road, Mudgee, was fined $880 and disqualified for three months to be followed by a 12-month interlock period.
At about 1.45am on Saturday, August 3, 2019, police patrolling Sydney Road, Mudgee, saw Thompson turn left from Burrundulla Avenue.
They followed and stopped him for a random breath test, which was positive for alcohol, and took him to Mudgee Police Station where a breath analysis of 0.121 was recorded.
The police facts submitted to the court noted that an open can of pre-mixed rum was seen in the vehicle's cup-holder. Upon reading this, Magistrate David Day commented, "some people lead exciting lives".
His honour also observed the defendant's driving record and remarked, "you had one ticket before this act of foolishness - you should've caught a cab".
Thompson, who represented himself in court, said that he has an apprentice who can drive him to work while he's off the road.
"He better keep his licence," Magistrate Day said.
