Luke Tribe of Bumberra Place, Bombira, was charged with 'Larceny' and 'Enter inclosed land not prescribed premises without lawful excuse'.
At the time of the incident the Australian Rail Track Corporation (ARTC) were conducting maintenance on the line between Gulgong and Stubbo. The work included the removal and replacement of sleepers and plates, and the old items were left in piles along the corridor.
During the early hours of Wednesday, February 27, 2019, Tribe and the co-accused entered the corridor at the Gulgong end - both driving their own vehicles - and drove through to Winstons Lane, Stubbo.

In doing so they passed the displayed 'No Entry' signs. Once inside they began loading 200-300 railway plates each into their respective trailers.
A number of rail workers arrived and spotted the pair. One took a photo of Tribe's number plate, however had to first remove a plastic bag that was covering it.
They were told to leave and did so, taking the railway plates with them.
Tribe refused to be interviewed by police, however the co-accused said he'd covered the number plate so passing trains couldn't see it. And admitted that he planned to use the stolen items to make barbecue and fire pits.
The co-accused was sentenced for his part in the incident in May last year. Tribe had entered pleas of 'not guilty', however pleaded guilty when the matter was finalised in Mudgee Local Court last Friday.
