Hayden James Mogg, of Mortimer Street, Mudgee, was also sentenced in Mudgee Local Court on Tuesday, June 2, 2020, for a charge of having custody of a knife in a public place.
At about 10.55pm on Friday, November 8, 2019, the 28-year-old was driving along Church Street, Mudgee, at a speed that brought him to the attention of police.
They'd seen the vehicle stop at the BP service station and when Mogg returned to it, they noted that he was looking towards them.
The officers waited until he drove back onto Church Street and then stopped him.
A check of his identity revealed information of interest. Furthermore, he appeared to be nervous, telling them that he'd been "clean" for a while and had last used drugs six weeks earlier.
An oral fluid test was positive to cocaine and 1g of the drug was found in the centre console of the vehicle.
When questioned, Mogg admitted that the substance was cocaine, but claimed that he didn't know who put it there.
A further search located a 10cm folding knife in the glovebox and a 14cm knife in the pocket of the driver seat. Mogg said they were used for fishing, but no other gear was found in the vehicle.
He was taken to Mudgee Police Station, where a second sample returned a positive result for cocaine, which was confirmed following laboratory analysis.
